TERMS AND CONDITIONS OF USE OF THE BITMAHAVI PLATFORM

 By accessing the bitMahavi site and / or by creating an account on the bitMahavi site and / or by using any of the services provided through the BitMahavi Hosted Platform ("bitMahavi Services"), you unequivocally agree that you have read the terms and conditions of use of the Platform as detailed below ("Terms and Conditions") and agree to act as a User of the Platform and enjoy all rights reserved to users, as well as comply with the obligations of the users of the Platform, under the conditions set out below.

You also acknowledge that you have read and understood and agree to comply with the provisions of the Privacy and Personal Data Protection Policy (click here to access this Policy) and the Cookies Policy (click here to access this Policy), which form an integral part of this Agreement.

If you do not agree with the Terms and Conditions of Use of our services, please:

do not create the registration account on the bitMahavi site;

if you have already created such an account, delete the created account and all related data;

stop using any service provided through the Platform;

inform us by email at support@bitmahavi.com and stop any other interaction with the Platform.

Violation of the Terms and Conditions may result in the termination of your account, as well as liability for any damages or breaches of the Terms and Conditions or legal obligations incumbent on you as a User of the Platform, as set forth below.

2. Updating the Terms and Conditions

We reserve the right to update and change the Terms and Conditions at any time, for a variety of reasons, such as updating them in accordance with applicable law changes, new regulations, or changes in business practices. We will notify you of these changes by updating the Terms and Conditions and posting them through the Platform and changing the date of the "Last Revision" on this page. Changes to the Terms and Conditions will also be communicated to you through your User Account. The amended version of the Terms and Conditions will take effect as soon as it is communicated to you, unless expressly provided otherwise.

In all cases, changes to the new functions of the Service or changes required by legal regulations will take effect immediately, even without prior notice. If you do not agree to the amended Terms and Conditions, please stop using the bitMahavi Services and delete your Platform access account.

All new features that increase or enhance the services already offered will be subject to the Terms and Conditions. Your continued use of the bitMahavi Services after such changes will have the legal significance of the direct and unequivocal manifestation of your consent to the Terms and Conditions, as updated.

3. Definitions

The use of bitMahavi Services requires familiarity and even in-depth knowledge of specific terms specific to non-banking financial services based on digital technologies. bitMahavi assumes no responsibility for the degree of understanding and training of each and every user of the Platform, the accumulation of knowledge and skills necessary to understand and operate with the specific terms of bitMahavi Services being a prerequisite for each of you to contract any of the services provision through the Platform.

When used in this Agreement, the following terms shall have the meanings hereunder:

"BTC" is the abbreviation for open-source digital currency called Bitcoin, which operates on the basis of a peer-to-peer network and asymmetric cryptography with which transactions can be concluded through a public register common to all holders of Bitcoin created based on blockchain technology;

"Cryptocurrency" means any of the digital currencies that may be subject to the BitMahavi Services through the Platform, namely BTC, ETH or LTC;

4. Risks associated with the use of cryptocurrencies

By submitting instructions for using cryptocurrencies, you confirm that you are aware of and have the competence and ability to assess the risks associated with the use of cryptocurrencies, including but not limited to BTC, ETH, LTC, in terms of buying, selling, holding and exchanging other FIAT currencies, the results of a transaction depending on the evolution of the price of these cryptocurrencies in the markets and / or platforms on which they are traded. (and which bitMahavi cannot influence), the price changing rapidly, being able to increase or decrease, or even reach zero in a very short time. Thus, you confirm that you are fully aware that the cryptocurrency market has strong volatile characteristics.

At the same time, you state that you are fully aware that this type of transaction requires training and experience in cryptocurrency to properly understand and manage the risks involved, taking into account all of the above, and that you have the ability and knowledge to to use bitMahavi Services.

In order to avoid any doubt regarding the use of bitMahavi Services, by agreeing to use these services, you agree that all risks associated with trading and holding cryptocurrencies are borne by you, including, but not limited to, the volatility of cryptocurrency prices, business and / or profits generated by the holding / trading of cryptocurrencies, the fluctuation of their related exchange rates and the financial risks mentioned above.

5. Eligibility

In order to benefit from the bitMahavi Services, the User must be at least 18 years old in order to create an Account on the Platform and thus use the Service. By creating an Account and using the Service, you represent and warrant that:

you have read and understood the Terms and Conditions; and

you have the capacity to exercise and accept the Terms and Conditions for the purpose of conducting a cryptocurrency transaction; and

you will abide by the Terms and Conditions and ensure that you do not violate any laws, regulations or other applicable regulations applicable in your country of residence and / or residence by using the bitMahavi Services; and

you are not prohibited from using the bitMahavi Services in accordance with your country's regulations and / or the decisions of the competent public authorities; and

no civil, administrative or criminal sanctions have been imposed on you in connection with your use of services similar to BitMahavi Services prior to your acquisition as a user of the Platform.

bitMahavi reserves the right not to approve the creation of a User Account and / or to suspend and / or close the created account if we consider that the eligibility conditions are not met.

We also reserve the right to select our customers based on their identity, nationality or nationality, to the extent that we suspect that the person, nationality or nationality of the user / client could be grounds for violation of mandatory rules of domestic or international law. .

BitMahavi services

The bitMahavi platform offers Users the opportunity to sell or buy cryptocurrencies. Thus, for the initiation of a transaction, you implicitly confirm that you are simultaneously fulfilling the following obligations:

The cryptocurrencies you trade do not come from illicit or illegal activities; and

you are the holder of the account in which you request the bank transfer and the real and final beneficiary of the amounts traded; and Selling cryptocurrencies is not money laundering; and

Declare at your own risk that the amount of money (RON / EUR / USD) used for the purchase of cryptocurrencies does not come from an illegal act.

Your bitMahavi user account gives you access to the following services:

 An online hosted account that allows Users to track and manage information about cryptocurrency transactions and through which bitMahavi can facilitate transactions in accordance with the instructions provided by the User or an authorized entity of bitMahavi ("online bitMahavi account");

The service of transferring cryptocurrencies to external wallets in the network specific to each cryptocurrency to your Account and vice versa ("Blockchain Network Transfer Service");

FIAT deposit or withdrawal service, (cash) by bank transfer;

When creating your User Account, you must follow these rules:

You must be a person; accounts registered by bots or other automated methods are not permitted and will be deleted without notice;

You must be at least 18 years old;

You do not have permission to create an Account using personal data of third parties or false data;

A User may have only one account on the Platform, otherwise the additional accounts created will be suspended or closed, in our sole discretion;

Any account created using false information will be deleted without prior notice;

Your personal data may be used in accordance with our Privacy Policy:

for the provision of bitMahavi Services;

for the fulfillment of legal reporting obligations in connection with preventing and combating money laundering, terrorist financing, fraud and other crimes against property through the Platform;

for requests for information or investigations, either directly or through third parties, which are deemed necessary to verify your identity or to protect you and / or us from crimes of a financial nature, such as fraud.
